Oropeza bill banning smoking at beaches, parks heads to governor's desk

California came one step closer Thursday to becoming the only state to ban smoking at beaches and parks.

A bill by Redondo Beach Democrat Jenny Oropeza passed the state Senate on a 21-15 vote in favor of the ban, which has already been approved by the Assembly. The bill is now headed to the desk of Gov. Arnold Schwarzenegger, who has not yet taken a position on the legislation.

Oropeza said she is optimistic that the governor will sign the bill, which would take effect Jan. 1, 2011.

"We have been working with his department staff all along on this," she said. "We are hopeful he will sign it."

Dozens of coastal cities and counties across California already have enacted smoking bans at beaches, including Hermosa Beach, Torrance, Palos Verdes Estates and Rancho Palos Verdes.

In 2005, El Segundo was the first city to enact a ban on smoking at its beaches. In October, Redondo Beach became the last South Bay city to approve a beach smoking ban, which also encompassed city parks. Los Angeles banned smoking at its beaches in 2004 and in parks in 2008.

Oropeza said she modeled the statewide legislation on local ordinances. She hopes the statewide law will reduce litter, threats of wildfire and health risks from secondhand smoke at parks and beaches.

"We hope we can accomplish those things through education, and not through issuing citations," she said. "If that were to happen without issuing a single citation, that would be fine with me."

Oropeza's bill would allow for a $100 fine for those caught smoking at 278 state beaches and parks. Smoking would still be allowed at state-run campgrounds and parking lots.

State Republicans, along with the tobacco industry, opposed the bill, which they said would contribute to a "nanny state."

The tobacco industry also argued that the bill would infringe on smokers' rights.
